Whenever we visit our doctor, a hospital, or any healthcare facility we have expectations that certain standards of care will be met. Obviously we hope to not be harmed in anyway whether through negligence, substandard care, or actual mistreatment. When these expectations are not met or we suffer harm in any way as a result of medical care, medical malpractice may be taking place. Technically defined, medical malpractice is professional negligence by act or omission by a health care provider in which care does not meet accepted standards of practice in the medical community. This may result in injury or perhaps even death to a patient. Unfortunately, the occurrence of this unfortunate practice is frequent enough that all medical professionals are required to maintain liability insurance to handle the risk and loss financially. This cost is passed on to patients and the public resulting in even higher health care costs. 
Often, determining whether or not medical malpractice has taken place is a difficult task. There are websites, other doctors, and resources for determining what an acceptable level of medical care looks like. Some cases may be obvious such as a wrongful death or an additional complication which may occur during an outpatient procedure. In other situations, the patient or the patient’s family may be unsure if negligence or mistreatment of some kind has occurred. Once a case of malpractice has been discovered the question of litigation arises. Is there a significant case against the medical professional or healthcare facility? Would the cost of litigating the case be financially beneficial? The average cost for litigating a malpractice case is between $50,000 and $100,000. If the total damages do not match the bottom figure it may not be wise to pursue the case. In this instance, there may be other options like filing a complaint with the state board of health. Many times this could result in an investigation and perhaps a discovery of wrongdoing which might result in the hospital or medical professional being willing to pay for damages. |
